El expediente contaba con pruebas en contra de Mariño, pero el Tribunal al realizar el análisis de las mismas, logró establecer que no eran creíbles las versiones en contra del ex Gobernador y que se habían desestimado y desconocido las pruebas a su favor que tenían mayor peso.
Las versiones en contra de Mariño, eran de miembros de las Autodefensas Campesinas de Casanare, condenados por masacres, homicidios y otros delitos. Sin embargo, con las pruebas y las mismas contradicciones, se logró probar que no decían la verdad y se logró demostrar la presunción de inocencia.
