La JEP concluyó que ellos participaron en el asesinato de 303 personas, en 218 eventos ocurridos en Casanare, Boyacá, Meta y Arauca.
Las personas asesinadas, fueron presentadas ilegítimamente como bajas en combate. Además, se referirán a los daños causados a las víctimas, así como a la organización criminal que se implantó en la Brigada XVI entre 2005 y 2008.
Así mismo, han sido citados a la diligencia judicial: César Augusto Cómbita Eslava, Jorge Eduwin Gordillo Benítez, Wilfrido Domínguez Márquez, Gildardo Antonio Jiménez Castrillón, Wilson Camargo Tamayo, Jaime Alberto Rivera Mahecha, Edwin Leonardo Toro Ramírez, Jhon Alexander Suancha Florián, Gélver Pérez García, Marcolino Puerto Jiménez, Marco Fabián García Céspedes, Miguel Andrés Sierra García, Erwin Eduardo Duarte Rojas, Leandro Eliécer Moná Cano, Alexander González Almario, Wilson Salvador Burgos Jiménez, Wilson Rodríguez Mimisica, Miguel Fernando Ramírez, Zamir Humberto Casallas Valderrama, Faiber Alberto Amaya Ruiz y Orlando Rivas Tovar.
Como parte de la diligencia judicial, los 22 máximos responsables y dos partícipes no determinantes, deberán pasar del reconocimiento escrito que ya entregaron a la magistratura de la JEP, a un reconocimiento público de las atrocidades ante la justicia, las víctimas y la sociedad.
Los efectos restauradores de este reconocimiento público pueden significar la oportunidad más directa que tienen los responsables de atender las demandas de responsabilidad y de verdad de las víctimas.
Entre otras cosas, los imputados deberán aportar verdad detallada sobre hechos individuales en los términos de su participación en el plan criminal y, además, nombrar y aceptar los daños causados.
Durante siete meses, un grupo de expertos profesionales de la JEP ha trabajado en la preparación de esta audiencia pública, tanto con víctimas como con comparecientes.
Este es un proceso que conduce a lograr que la diligencia permita públicamente sellar un compromiso de futuro entre quienes sufrieron el daño, quienes lo causaron y la sociedad en general, para restablecer el tejido social fracturado por los graves crímenes.
A la fecha, se han realizado tres encuentros preparatorios restaurativos con víctimas en la ciudad de Yopal, seis reuniones de concertación con representantes de víctimas, dos reuniones virtuales con representantes de comparecientes, cuatro encuentros preparatorios restaurativos con comparecientes y un encuentro preparatorio individual de nivelación con el último imputado.
De los 26 imputados por los crímenes cometidos en Casanare, dos oficiales no aceptaron responsabilidad y serán investigados por la Unidad de Investigación y Acusación (UIA) de la JEP.
